Company Operations Manual - ICAO vs FAA Requirements

Operators of international general aviation turbojet or large aircraft having a takeoff weight over 5,700 kg (12,563 lbs) have been required to carry a “Company Operations Manual” , including “Safety Management System” (SMS) to comply with requirements of participating ICAO Member States since, 18 November 2010.

ICAO States (countries) that are enforcing Annex 6, Part II require operators, to develop, implement and carry on aboard the Company Operations Manual in order to operate in international airspace and destinations within their area. Failure to carry a compliant Company Operations Manual in certain States may be delayed or refused entry. 

While the FAA encourages participation, they only mandate operators to comply when FAR 91.703 is applicable when it obligates US Registered aircraft operators to comply with this requirement in international airspace and when participating States have are conducting enforcement of ICAO Annex 6 Part II.    

Operators can develop a Company Operations Manual using the guidance material contained in ICAO Annex 6, Part II, ICAO Safety Management Manual doc 9859 and FAA Advisory Circular.

“Off the Shelf” or “One Size Fits All” manuals DO NOT meet the ICAO requirements for SMS.

MEL Approval: This crucial approval allows the dispatch of aircraft with minor defects that do not pose a risk to flight safety. While non-commercial general aviation operators of US-registered aircraft in US Airspace may view this as optional, it is a mandatory element for compliance with ICAO Annex 6 Part 2.

International LOA Authorizations: To facilitate your operations in international airspace, we offer a comprehensive list of common international airspace approvals. It’s important to understand that these authorizations are not transferable to new owners/operators. Similarly, the company operations manual of the previous owner/operator cannot be transferred, necessitating the creation of a new program by each new operator for proper recognition.
