FAA Part 91 MEL Compliance Options - D095 vs D195 MEL’s

  • D095 is FAA Approved and accepted in most areas of the world.

  • D195 is a more formal FAA Approval and preferred by authorities in some areas of the world.

Understanding Part 91 MEL Compliance

US 14 CFR Part 91.213 “Inoperative Systems and Equipment” states the requirements for operators to “ Defer Defects Prior to Departure” using an FAA MEL program, including flying internationally. 

ICAO Annex 6 Part 2 states, “When a master minimum equipment list (MMEL) is established for the aircraft type, the operator shall include in the operations manual a minimum equipment list (MEL) approved by the state of registry.” 14 CFR 91.703 then applies mandating the MEL because of the ICAO mandate. 

US Aircraft Operators requesting FAA Authorization to defer defects using either the D195 MEL or the less formal D095 MMEL as MEL are required by FAA to:  

Develop Maintenance & Operating (M&O) procedures using Flight Manuals, Manufactures Guidance, FAA Regulations and Advisory Circulars.

Integrate FAA Policy Letters into the MEL Document such as, the FAA Preamble and Definitions applicable to the MEL

Develop a means of recording deferred maintenance items for flight crew prior to each departure.

Establish means of Placarding and Approved “Return to Service for affected components.

CAUTION Airworthiness Authorities or Maintenance Organizations have, on occasion, withheld release of aircraft for departure unless an accepted MEL Program is in use by the operator.
